Withdrawal

Withdrawal

As a host of factors make up a funder’s decision to invest in a claim (see investment policy) and because all litigation constantly evolves and changes, it’s important that funders are able to regularly review their funded cases and to withdraw on proper grounds.  Legally, the claimant’s isn’t obliged to continue litigation that it has lost faith in and the administration of justice may not be best served by making funders continue with claims they have come to regard as unmeritorious.  Commercially, a funder will not take a decision to withdraw lightly because it would almost certainly mean the loss of its investment to that point and, of course, affect it reputation in the market
