Adverse Costs Asset
A litigant, whether claimant or defendant, in whose favour a costs order has been made, may be forced to wait many months to realise the value in that order. Indeed, in many cases it will be the lawyers, rather than their clients, who are out of pocket pending the resolution of the costs assessment process.
