Adverse costs

In England (unlike the US) costs usually ‘follow the event’ so, subject to assessment, the losing party (claimant or defendant) pays the winning party’s costs

 

The adverse cost risk can be retained by the parties or laid off.  Third party litigation funding can extend to adverse costs or the potential liability can be insured, in whole or part, using ATE insurance
